What follows is the agreed structure of this document, not the document itself. The binding wording is being drafted and reviewed by a qualified lawyer, and it replaces this outline before the site opens to the public. Nothing on this page creates or limits any obligation.

We publish the outline rather than a placeholder because you are entitled to know what a policy will cover before you can read it, and because a page of convincing-looking text that no lawyer has seen is worse than an empty one: there would be no way to tell the two apart.

What this document covers

  1. 01Designated agent

    Name and contact details of the agent registered with the Copyright Office. Cannot be published before the registration exists.

  2. 02How to submit a notice

    The elements required by 17 U.S.C. 512(c)(3), listed in order so that a complete notice can be written from this page alone: identification of the work, location of the material, and the required statements made under penalty of perjury.

  3. 03What happens after a notice

    The timeline from receipt to action, what is removed and what is preserved, and how and when the affected party is notified.

  4. 04Counter-notification

    The statutory elements of a counter-notification, the restoration window that follows one, and the consent to jurisdiction that a counter-notifier is giving by sending it.

  5. 05Repeat infringers

    The repeat infringer termination policy required to maintain safe harbour, including what counts as a strike and how long a strike is held against an account.

  6. 06Misrepresentation

    Liability under 512(f) for knowing material misrepresentation, stated plainly, because a notice sent in bad faith is not a free action.

These are not adapted from a template pack. Several of the clauses only make sense here: no payment is ever taken on this domain, passwords are entered only on account pages, and all visual material is generated rather than photographed. Each of those facts changes the document that describes it, and a generic template would state the opposite.

Reviewed before, not after, launch

The thirteen documents are marked as launch blockers in the project’s own route map, which means the site is not considered releasable while any of them is still an outline. The review covers United States federal requirements and state privacy law, and the set is written independently of the sibling site rather than copied across.
